The current federal donation limit is too high and it allows individuals and organizations and their lobbyists to do favours for parties and candidates by funneling and bundling donations that unethically influence the decisions of Cabinet ministers (<a target=\"_blank\" href=\"https:\/\/democracywatch.ca\/wp-content\/uploads\/1ListOfShamCanPoliticalDonationSystems-1.pdf\" rel=\"noopener noreferrer\">Click here<\/a> for details about how the current donation limit is a fa\u00e7ade). Clinical testing by psychologists has shown that <a target=\"_blank\" href=\"https:\/\/www.youtube.com\/watch?v=cFdCzN7RYbw\" rel=\"noopener noreferrer\">even small gifts and favours have influence<\/a> and are the best way to influence someone\u2019s decisions.<\/p>\n\n<p><em>\u201cThe only way to stop the unethical influence of big money in politics is to stop big money donations and loans, as Quebec has, and to ban gifts, <a target=\"_blank\" href=\"https:\/\/democracywatch.ca\/lobbying-commissioner-rules-mps-and-senators-have-put-loopholes-in-federal-ethics-rules-to-allow-lobbyists-to-bribe-them-with-travel-junkets\/\" rel=\"noopener noreferrer\">including sponsored travel<\/a>, and restrict and require disclosure of all favours including volunteer help on campaigns,\u201d<\/em> said Duff Conacher, Co-founder of Democracy Watch (<a target=\"_blank\" href=\"https:\/\/democracywatch.ca\/more-than-85000-call-for-changes-to-bill-c-76-to-stop-the-unethical-influence-of-big-money-in-federal-politics\/\" rel=\"noopener noreferrer\">Click here to see the 11 key changes<\/a> needed to stop big money in federal politics).<\/p>\n\n\n<h3>Stop secret, unethical lobbying<\/h3>\n\n<p>In 2012, the House Ethics Committee <a target=\"_blank\" href=\"https:\/\/democracywatch.ca\/house-committee-recommends-some-key-changes-to-strengthen-federal-lobbying-act-and-enforcement-system-but-fails-to-address-huge-loopholes-that-allow-secret-unethical-lobbying-of-the-federal-governme\/\" rel=\"noopener noreferrer\">unanimously recommended some key changes<\/a> to the <em>Lobbying Act<\/em> (<a target=\"_blank\" href=\"https:\/\/democracywatch.ca\/secret-unethical-lobbying-will-still-be-legal-if-federal-conservatives-dont-do-more\/\" rel=\"noopener noreferrer\">no changes were made<\/a>) but not all the changes needed to close all the loopholes and require that all lobbying be publicly disclosed and in compliance with the <em>Lobbyists\u2019 Code of Conduct<\/em> (as the <a target=\"_blank\" href=\"https:\/\/democracywatch.ca\/trudeau-liberals-appeal-of-federal-court-ruling-ordering-lobbying-commissioner-to-investigate-aga-khans-bahamas-trip-gift-to-pm-trudeau-in-court-today\/\" rel=\"noopener noreferrer\">Aga Khan\u2019s unethical lobbying of Prime Minister Trudeau showed clearly<\/a>).  The <em>Lobbying Act<\/em> was <a target=\"_blank\" href=\"https:\/\/www.theglobeandmail.com\/politics\/article-ethics-committee-to-consider-review-of-conflict-of-interest-and\/\" rel=\"noopener noreferrer\">supposed to be reviewed by the Ethics Committee in 2017<\/a>, but the Committee and Parliament have negligently failed to undertake the review.<\/p>\n\n<p>One of the key changes is to require all politicians, their staff, appointees, and government officials and employees to register in the <a target=\"_blank\" href=\"https:\/\/lobbycanada.gc.ca\/app\/secure\/ocl\/lrs\/do\/guest\" rel=\"noopener noreferrer\">Registry of Lobbyists<\/a> every communication with anyone communicating with them in respect of any decision.The only exception to this disclosure requirement should be if someone sends an email letter through a lobby group\u2019s website (as the group would be required to register that mass letter-writing campaign action in its lobbying registration in the Registry).<\/p>\n\n<p><em>\u201cIf even some of the loopholes that allow for secret lobbying had been closed years ago, everyone at WE Charity would have been prohibited from lobbying the Prime Minister\u2019s and Finance Minister\u2019s offices and department because of their connections,\u201d<\/em> said Conacher.  <em>\u201cThe secret, unethical lobbying loopholes in the federal \u201cSome Lobbying Act\u201d must be closed because they are a recipe for corruption and waste of the public\u2019s money, in part because lobbyists who are not required to register their lobbying are not covered by the lobbyists\u2019 ethics code and so are allowed to develop close relationships with politicians and officials they are lobbying, including campaigning or doing favours for them.\u201d<\/em><\/p>\n\n\n<h3>Stop excessive government secrecy<\/h3>\n\n<p>Secret lobbying is just one part of excessive federal government secrecy.  Like the <a target=\"_blank\" href=\"https:\/\/democracywatch.ca\/federal-conservatives-accountability-and-democratic-reform-record-gets-an-f-for-breaking-many-promises-and-practising-politics-as-usual-3\/\" rel=\"noopener noreferrer\">Harper Conservatives did<\/a>, the Trudeau Liberals have <a target=\"_blank\" href=\"https:\/\/democracywatch.ca\/report-card-gives-trudeau-liberal-open-government-record-an-f-as-international-summit-held-in-ottawa\/\" rel=\"noopener noreferrer\">broken almost all their 2015 open government election promises<\/a>, including applying the <em>Access to Information Act<\/em> to ministers\u2019 offices, and making federal government information open by default.<\/p>\n\n<p><em>\u201cThe many loopholes in the federal \u2018Guide to Keeping Information Secret Act\u2019 must be closed to end the culture of excessive secrecy that often hides wrongdoing and wrongdoers in the federal government,\u201d<\/em> said Conacher.<\/p>\n\n\n<h3>Stop unethical decision-making<\/h3>\n\n<p>A loophole in the federal <em><a target=\"_blank\" href=\"https:\/\/laws-lois.justice.gc.ca\/eng\/acts\/c-36.65\/\" rel=\"noopener noreferrer\">Conflict of Interest Act<\/a><\/em>, which also exists in the <a target=\"_blank\" href=\"https:\/\/www.ourcommons.ca\/about\/standingorders\/appa1-e.htm\" rel=\"noopener noreferrer\">MPs\u2019 ethics code<\/a> and the <a target=\"_blank\" href=\"http:\/\/www.sen.parl.gc.ca\/seo-cse\/PDF\/CodeJune2014.pdf\" rel=\"noopener noreferrer\">Senate ethics code<\/a>, allows all federal Cabinet ministers, their staff and appointees, to participate in decisions even when they have a direct interest in the outcome and could profit from their decision, as long as the decision applies generally.  Staff of MPs and senators are not even covered by any ethics rules.<\/p>\n\n<p><em>\u201cThe federal ethics law should be called the \u2018Almost Impossible to be in a Conflict of Interest Act\u2019 because it has a huge loophole which means it doesn\u2019t apply to 99 percent of the decisions and actions of Cabinet ministers, their staff and appointees, and allows them to profit from their decisions, and MP and senator ethics codes have the same loophole,\u201d<\/em> said Conacher.  <em>\u201cThis loophole must be closed, and everyone in federal politics must be prohibited from participating in any decision-making process when they have even the appearance of a conflict of interest.\u201d<\/em><\/p>\n\n<p>To be clear, the <i>Conflict of Interest Act<\/i>, and MP and senator codes, already prohibit participating in decision-making processes that only specifically affect one or a few people or entities when in the appearance of a conflict of interest, although this could be clarified by specifying that apparent conflicts of interest are covered.  The key change needed is to close the huge loophole that allows ministers, top government officials, MPs and senators, and their staff, to participate in all decisions, including decisions that apply generally, when they have any kind of conflict of interest.<\/p>\n\n<p><i>&#8220;Because of this huge loophole in the federal ethics law, it would have been legal for Prime Minister Trudeau and Finance Minister Morneau if they had decided themselves to create a youth volunteer service granting fund that many organizations could apply to for funding even if they knew for sure that one of their families\u2019 favourite charities, WE Charity, would receive significant grants from the fund,<\/i>\u201d said Conacher.<\/p>\n\n<p><em>\u201cAs well, a rule requiring honesty should be added to the federal ethics law and codes, to ensure politicians and government officials are penalized if they mislead voters about anything, including their own wrongdoing,\u201d<\/em> said Conacher.  See details <a target=\"_blank\" href=\"https:\/\/democracywatch.ca\/campaigns\/honesty-in-politics-campaign\/\" rel=\"noopener noreferrer\">here<\/a>.<\/p>\n\n<p>In truly incredible contrast, the <a target=\"_blank\" href=\"https:\/\/www.tbs-sct.gc.ca\/pol\/doc-eng.aspx?id=32627\" rel=\"noopener noreferrer\">rules<\/a> and <a target=\"_blank\" href=\"https:\/\/www.tbs-sct.gc.ca\/pol\/doc-eng.aspx?id=25049\" rel=\"noopener noreferrer\">code<\/a> that Cabinet ministers have imposed on lower level federal government employees, who don\u2019t have much decision-making power, prohibit them from participating in all decisions if they have even a potential or apparent of a conflict of interest (even if the decision applies generally), and require them to provide honest advice, and they can be suspended or fired for violations.<\/p>\n\n<p>As well, so-called \u201cblind trusts\u201d should be banned (as the 1984 Starr-Sharp Report and 1987 Parker Commission <a target=\"_blank\" href=\"https:\/\/www.aph.gov.au\/About_Parliament\/Parliamentary_Departments\/Parliamentary_Library\/Publications_Archive\/CIB\/CIB9697\/97cib14#AE\" rel=\"noopener noreferrer\">both recommended<\/a>) because the person knows what investments they put in their trust.  Instead, all politicians and officials should be required to sell their investments while in office (as the Parker Commission also recommended).<\/p>\n\n<p>Conflict of interest \u201cscreens\u201d should also be banned because <a target=\"_blank\" href=\"https:\/\/democracywatch.ca\/federal-court-of-appeal-ruling-allows-ethics-commissioner-to-use-conflict-of-interest-screens-to-replace-publicly-declared-recusals\/\" rel=\"noopener noreferrer\">they are smokescreens<\/a> that hide whether a politician or official is actually recusing themselves from decisions when they have a conflict of interest.<\/p>\n\n\n<h3>Stop questionable sole-source spending<\/h3>\n\n<p>Loopholes also need to be closed that allow federal government institutions <a target=\"_blank\" href=\"https:\/\/buyandsell.gc.ca\/policy-and-guidelines\/supply-manual\/section\/3\/15\" rel=\"noopener noreferrer\">to hand out sole-source contracts<\/a> for very questionable reasons, and they should be required to do a compliance check with the Auditor General when initiating any significant spending process.<\/p>\n\n\n<h3>Strengthen enforcement, penalties and whistleblower protection<\/h3>\n\n<p>The watchdogs who enforce these rules (<a target=\"_blank\" href=\"https:\/\/ciec-ccie.parl.gc.ca\/en\/Pages\/default.aspx\" rel=\"noopener noreferrer\">ethics<\/a>, <a target=\"_blank\" href=\"https:\/\/lobbycanada.gc.ca\/en\/\" rel=\"noopener noreferrer\">lobbying<\/a>, <a target=\"_blank\" href=\"https:\/\/www.oic-ci.gc.ca\/en\" rel=\"noopener noreferrer\">information<\/a> and <a target=\"_blank\" href=\"https:\/\/www.psic-ispc.gc.ca\/\" rel=\"noopener noreferrer\">integrity<\/a> commissioners, and <a target=\"_blank\" href=\"https:\/\/www.oag-bvg.gc.ca\/internet\/English\/admin_e_41.html\" rel=\"noopener noreferrer\">auditor general<\/a> and <a target=\"_blank\" href=\"https:\/\/www.canada.ca\/en\/procurement-ombudsman.html\" rel=\"noopener noreferrer\">procurement ombudsman<\/a>) are handpicked by the Cabinet through secretive, biased processes, as the <a target=\"_blank\" href=\"https:\/\/democracywatch.ca\/federal-court-of-appeal-rules-trudeau-cabinet-was-biased-when-appointing-ethics-commissioner-and-lobbying-commissioner\/\" rel=\"noopener noreferrer\">Federal Court of Appeal recently ruled<\/a>.<\/p>\n\n<p>As a result, the watchdogs often <a target=\"_blank\" href=\"https:\/\/democracywatch.ca\/campaigns\/audit-ethics-commissioner-lobbying-commissioner\/\" rel=\"noopener noreferrer\">act like lapdogs<\/a>, failing to conduct audits to discover wrongdoing (audits which are needed to supplement <a target=\"_blank\" href=\"https:\/\/www.fintrac-canafe.gc.ca\/guidance-directives\/overview-apercu\/cpf\/cpf-eng\" rel=\"noopener noreferrer\">FINTRAC\u2019s anti-bribery inspections<\/a> (that also <a target=\"_blank\" href=\"https:\/\/www.cbc.ca\/news\/politics\/money-laundering-banks-terror-1.4603064\" rel=\"noopener noreferrer\">need to be strengthened<\/a>)), and letting many people off the hook with very questionable, secret rulings.  Very unfortunately, <a target=\"_blank\" href=\"https:\/\/www.ctvnews.ca\/politics\/appeal-court-nixes-fresh-lobby-probe-of-aga-khan-in-trudeau-vacation-case-1.4879782\" rel=\"noopener noreferrer\">the Federal Court of Appeal has ruled that federal ethics and lobbying watchdogs\u2019 rulings can\u2019t be challenged<\/a> (To see the ruling, <a target=\"_blank\" href=\"https:\/\/decisions.fca-caf.gc.ca\/fca-caf\/decisions\/en\/item\/469451\/index.do?q=democracy+watch\" rel=\"noopener noreferrer\">click here<\/a>).<\/p>\n\n<p>As well, there are no penalties for politicians who violate key ethics rules, or for politicians government officials who violate key spending rules, other than a public report.<\/p>\n\n<p><em>\u201cCanada\u2019s key good government watchdogs must be chosen by an independent commission, not by Cabinet ministers and officials they watch over, and they must be required to conduct audits and issue public rulings on every questionable situation, and empowered to impose high fines on violators, with everyone having the right to challenge their rulings in court,\u201d<\/em> said Conacher.<\/p>\n\n<p>Finally, staff of politicians and parties <a target=\"_blank\" href=\"https:\/\/democracywatch.ca\/bill-c-65-just-nice-words-on-paper\/\" rel=\"noopener noreferrer\">are not protected by the federal whistleblower protection system<\/a>, weak as it is.  A <a target=\"_blank\" href=\"https:\/\/democracywatch.ca\/house-committee-recommends-key-changes-to-strengthen-federal-government-whistleblower-protection-will-the-liberals-finally-make-the-changes\/\" rel=\"noopener noreferrer\">House Committee unanimously recommended in June 2017<\/a> most of the key changes to make the system effective. The current federal donation limit is too high and it allows individuals and organizations and their lobbyists to do favours for parties and candidates by funneling and bundling donations that unethically influence the decisions of Cabinet ministers (<a target=\"_blank\" href=\"https:\/\/democracywatch.ca\/wp-content\/uploads\/1ListOfShamCanPoliticalDonationSystems-1.pdf\" rel=\"noopener noreferrer\">Click here<\/a> for details about how the current donation limit is a fa\u00e7ade). Clinical testing by psychologists has shown that <a target=\"_blank\" href=\"https:\/\/www.youtube.com\/watch?v=cFdCzN7RYbw\" rel=\"noopener noreferrer\">even small gifts and favours have influence<\/a> and are the best way to influence someone\u2019s decisions.<\/p>\n\n<p><em>\u201cThe only way to stop the unethical influence of big money in politics is to stop big money donations and loans, as Quebec has, and to ban gifts, <a target=\"_blank\" href=\"https:\/\/democracywatch.ca\/lobbying-commissioner-rules-mps-and-senators-have-put-loopholes-in-federal-ethics-rules-to-allow-lobbyists-to-bribe-them-with-travel-junkets\/\" rel=\"noopener noreferrer\">including sponsored travel<\/a>, and restrict and require disclosure of all favours including volunteer help on campaigns,\u201d<\/em> said Duff Conacher, Co-founder of Democracy Watch (<a target=\"_blank\" href=\"https:\/\/democracywatch.ca\/more-than-85000-call-for-changes-to-bill-c-76-to-stop-the-unethical-influence-of-big-money-in-federal-politics\/\" rel=\"noopener noreferrer\">Click here to see the 11 key changes<\/a> needed to stop big money in federal politics).<\/p>\n\n\n<h3>Stop secret, unethical lobbying<\/h3>\n\n<p>In 2012, the House Ethics Committee <a target=\"_blank\" href=\"https:\/\/democracywatch.ca\/house-committee-recommends-some-key-changes-to-strengthen-federal-lobbying-act-and-enforcement-system-but-fails-to-address-huge-loopholes-that-allow-secret-unethical-lobbying-of-the-federal-governme\/\" rel=\"noopener noreferrer\">unanimously recommended some key changes<\/a> to the <em>Lobbying Act<\/em> (<a target=\"_blank\" href=\"https:\/\/democracywatch.ca\/secret-unethical-lobbying-will-still-be-legal-if-federal-conservatives-dont-do-more\/\" rel=\"noopener noreferrer\">no changes were made<\/a>) but not all the changes needed to close all the loopholes and require that all lobbying be publicly disclosed and in compliance with the <em>Lobbyists\u2019 Code of Conduct<\/em> (as the <a target=\"_blank\" href=\"https:\/\/democracywatch.ca\/trudeau-liberals-appeal-of-federal-court-ruling-ordering-lobbying-commissioner-to-investigate-aga-khans-bahamas-trip-gift-to-pm-trudeau-in-court-today\/\" rel=\"noopener noreferrer\">Aga Khan\u2019s unethical lobbying of Prime Minister Trudeau showed clearly<\/a>).  The <em>Lobbying Act<\/em> was <a target=\"_blank\" href=\"https:\/\/www.theglobeandmail.com\/politics\/article-ethics-committee-to-consider-review-of-conflict-of-interest-and\/\" rel=\"noopener noreferrer\">supposed to be reviewed by the Ethics Committee in 2017<\/a>, but the Committee and Parliament have negligently failed to undertake the review.<\/p>\n\n<p>One of the key changes is to require all politicians, their staff, appointees, and government officials and employees to register in the <a target=\"_blank\" href=\"https:\/\/lobbycanada.gc.ca\/app\/secure\/ocl\/lrs\/do\/guest\" rel=\"noopener noreferrer\">Registry of Lobbyists<\/a> every communication with anyone communicating with them in respect of any decision.The only exception to this disclosure requirement should be if someone sends an email letter through a lobby group\u2019s website (as the group would be required to register that mass letter-writing campaign action in its lobbying registration in the Registry).<\/p>\n\n<p><em>\u201cIf even some of the loopholes that allow for secret lobbying had been closed years ago, everyone at WE Charity would have been prohibited from lobbying the Prime Minister\u2019s and Finance Minister\u2019s offices and department because of their connections,\u201d<\/em> said Conacher.  <em>\u201cThe secret, unethical lobbying loopholes in the federal \u201cSome Lobbying Act\u201d must be closed because they are a recipe for corruption and waste of the public\u2019s money, in part because lobbyists who are not required to register their lobbying are not covered by the lobbyists\u2019 ethics code and so are allowed to develop close relationships with politicians and officials they are lobbying, including campaigning or doing favours for them.\u201d<\/em><\/p>\n\n\n<h3>Stop excessive government secrecy<\/h3>\n\n<p>Secret lobbying is just one part of excessive federal government secrecy.  Like the <a target=\"_blank\" href=\"https:\/\/democracywatch.ca\/federal-conservatives-accountability-and-democratic-reform-record-gets-an-f-for-breaking-many-promises-and-practising-politics-as-usual-3\/\" rel=\"noopener noreferrer\">Harper Conservatives did<\/a>, the Trudeau Liberals have <a target=\"_blank\" href=\"https:\/\/democracywatch.ca\/report-card-gives-trudeau-liberal-open-government-record-an-f-as-international-summit-held-in-ottawa\/\" rel=\"noopener noreferrer\">broken almost all their 2015 open government election promises<\/a>, including applying the <em>Access to Information Act<\/em> to ministers\u2019 offices, and making federal government information open by default.<\/p>\n\n<p><em>\u201cThe many loopholes in the federal \u2018Guide to Keeping Information Secret Act\u2019 must be closed to end the culture of excessive secrecy that often hides wrongdoing and wrongdoers in the federal government,\u201d<\/em> said Conacher.<\/p>\n\n\n<h3>Stop unethical decision-making<\/h3>\n\n<p>A loophole in the federal <em><a target=\"_blank\" href=\"https:\/\/laws-lois.justice.gc.ca\/eng\/acts\/c-36.65\/\" rel=\"noopener noreferrer\">Conflict of Interest Act<\/a><\/em>, which also exists in the <a target=\"_blank\" href=\"https:\/\/www.ourcommons.ca\/about\/standingorders\/appa1-e.htm\" rel=\"noopener noreferrer\">MPs\u2019 ethics code<\/a> and the <a target=\"_blank\" href=\"http:\/\/www.sen.parl.gc.ca\/seo-cse\/PDF\/CodeJune2014.pdf\" rel=\"noopener noreferrer\">Senate ethics code<\/a>, allows all federal Cabinet ministers, their staff and appointees, to participate in decisions even when they have a direct interest in the outcome and could profit from their decision, as long as the decision applies generally.  Staff of MPs and senators are not even covered by any ethics rules.<\/p>\n\n<p><em>\u201cThe federal ethics law should be called the \u2018Almost Impossible to be in a Conflict of Interest Act\u2019 because it has a huge loophole which means it doesn\u2019t apply to 99 percent of the decisions and actions of Cabinet ministers, their staff and appointees, and allows them to profit from their decisions, and MP and senator ethics codes have the same loophole,\u201d<\/em> said Conacher.  <em>\u201cThis loophole must be closed, and everyone in federal politics must be prohibited from participating in any decision-making process when they have even the appearance of a conflict of interest.\u201d<\/em><\/p>\n\n<p>To be clear, the <i>Conflict of Interest Act<\/i>, and MP and senator codes, already prohibit participating in decision-making processes that only specifically affect one or a few people or entities when in the appearance of a conflict of interest, although this could be clarified by specifying that apparent conflicts of interest are covered.  The key change needed is to close the huge loophole that allows ministers, top government officials, MPs and senators, and their staff, to participate in all decisions, including decisions that apply generally, when they have any kind of conflict of interest.<\/p>\n\n<p><i>&#8220;Because of this huge loophole in the federal ethics law, it would have been legal for Prime Minister Trudeau and Finance Minister Morneau if they had decided themselves to create a youth volunteer service granting fund that many organizations could apply to for funding even if they knew for sure that one of their families\u2019 favourite charities, WE Charity, would receive significant grants from the fund,<\/i>\u201d said Conacher.<\/p>\n\n<p><em>\u201cAs well, a rule requiring honesty should be added to the federal ethics law and codes, to ensure politicians and government officials are penalized if they mislead voters about anything, including their own wrongdoing,\u201d<\/em> said Conacher.  See details <a target=\"_blank\" href=\"https:\/\/democracywatch.ca\/campaigns\/honesty-in-politics-campaign\/\" rel=\"noopener noreferrer\">here<\/a>.<\/p>\n\n<p>In truly incredible contrast, the <a target=\"_blank\" href=\"https:\/\/www.tbs-sct.gc.ca\/pol\/doc-eng.aspx?id=32627\" rel=\"noopener noreferrer\">rules<\/a> and <a target=\"_blank\" href=\"https:\/\/www.tbs-sct.gc.ca\/pol\/doc-eng.aspx?id=25049\" rel=\"noopener noreferrer\">code<\/a> that Cabinet ministers have imposed on lower level federal government employees, who don\u2019t have much decision-making power, prohibit them from participating in all decisions if they have even a potential or apparent of a conflict of interest (even if the decision applies generally), and require them to provide honest advice, and they can be suspended or fired for violations.<\/p>\n\n<p>As well, so-called \u201cblind trusts\u201d should be banned (as the 1984 Starr-Sharp Report and 1987 Parker Commission <a target=\"_blank\" href=\"https:\/\/www.aph.gov.au\/About_Parliament\/Parliamentary_Departments\/Parliamentary_Library\/Publications_Archive\/CIB\/CIB9697\/97cib14#AE\" rel=\"noopener noreferrer\">both recommended<\/a>) because the person knows what investments they put in their trust.  Instead, all politicians and officials should be required to sell their investments while in office (as the Parker Commission also recommended).<\/p>\n\n<p>Conflict of interest \u201cscreens\u201d should also be banned because <a target=\"_blank\" href=\"https:\/\/democracywatch.ca\/federal-court-of-appeal-ruling-allows-ethics-commissioner-to-use-conflict-of-interest-screens-to-replace-publicly-declared-recusals\/\" rel=\"noopener noreferrer\">they are smokescreens<\/a> that hide whether a politician or official is actually recusing themselves from decisions when they have a conflict of interest.<\/p>\n\n\n<h3>Stop questionable sole-source spending<\/h3>\n\n<p>Loopholes also need to be closed that allow federal government institutions <a target=\"_blank\" href=\"https:\/\/buyandsell.gc.ca\/policy-and-guidelines\/supply-manual\/section\/3\/15\" rel=\"noopener noreferrer\">to hand out sole-source contracts<\/a> for very questionable reasons, and they should be required to do a compliance check with the Auditor General when initiating any significant spending process.<\/p>\n\n\n<h3>Strengthen enforcement, penalties and whistleblower protection<\/h3>\n\n<p>The watchdogs who enforce these rules (<a target=\"_blank\" href=\"https:\/\/ciec-ccie.parl.gc.ca\/en\/Pages\/default.aspx\" rel=\"noopener noreferrer\">ethics<\/a>, <a target=\"_blank\" href=\"https:\/\/lobbycanada.gc.ca\/en\/\" rel=\"noopener noreferrer\">lobbying<\/a>, <a target=\"_blank\" href=\"https:\/\/www.oic-ci.gc.ca\/en\" rel=\"noopener noreferrer\">information<\/a> and <a target=\"_blank\" href=\"https:\/\/www.psic-ispc.gc.ca\/\" rel=\"noopener noreferrer\">integrity<\/a> commissioners, and <a target=\"_blank\" href=\"https:\/\/www.oag-bvg.gc.ca\/internet\/English\/admin_e_41.html\" rel=\"noopener noreferrer\">auditor general<\/a> and <a target=\"_blank\" href=\"https:\/\/www.canada.ca\/en\/procurement-ombudsman.html\" rel=\"noopener noreferrer\">procurement ombudsman<\/a>) are handpicked by the Cabinet through secretive, biased processes, as the <a target=\"_blank\" href=\"https:\/\/democracywatch.ca\/federal-court-of-appeal-rules-trudeau-cabinet-was-biased-when-appointing-ethics-commissioner-and-lobbying-commissioner\/\" rel=\"noopener noreferrer\">Federal Court of Appeal recently ruled<\/a>.<\/p>\n\n<p>As a result, the watchdogs often <a target=\"_blank\" href=\"https:\/\/democracywatch.ca\/campaigns\/audit-ethics-commissioner-lobbying-commissioner\/\" rel=\"noopener noreferrer\">act like lapdogs<\/a>, failing to conduct audits to discover wrongdoing (audits which are needed to supplement <a target=\"_blank\" href=\"https:\/\/www.fintrac-canafe.gc.ca\/guidance-directives\/overview-apercu\/cpf\/cpf-eng\" rel=\"noopener noreferrer\">FINTRAC\u2019s anti-bribery inspections<\/a> (that also <a target=\"_blank\" href=\"https:\/\/www.cbc.ca\/news\/politics\/money-laundering-banks-terror-1.4603064\" rel=\"noopener noreferrer\">need to be strengthened<\/a>)), and letting many people off the hook with very questionable, secret rulings.  Very unfortunately, <a target=\"_blank\" href=\"https:\/\/www.ctvnews.ca\/politics\/appeal-court-nixes-fresh-lobby-probe-of-aga-khan-in-trudeau-vacation-case-1.4879782\" rel=\"noopener noreferrer\">the Federal Court of Appeal has ruled that federal ethics and lobbying watchdogs\u2019 rulings can\u2019t be challenged<\/a> (To see the ruling, <a target=\"_blank\" href=\"https:\/\/decisions.fca-caf.gc.ca\/fca-caf\/decisions\/en\/item\/469451\/index.do?q=democracy+watch\" rel=\"noopener noreferrer\">click here<\/a>).<\/p>\n\n<p>As well, there are no penalties for politicians who violate key ethics rules, or for politicians government officials who violate key spending rules, other than a public report.<\/p>\n\n<p><em>\u201cCanada\u2019s key good government watchdogs must be chosen by an independent commission, not by Cabinet ministers and officials they watch over, and they must be required to conduct audits and issue public rulings on every questionable situation, and empowered to impose high fines on violators, with everyone having the right to challenge their rulings in court,\u201d<\/em> said Conacher.<\/p>\n\n<p>Finally, staff of politicians and parties <a target=\"_blank\" href=\"https:\/\/democracywatch.ca\/bill-c-65-just-nice-words-on-paper\/\" rel=\"noopener noreferrer\">are not protected by the federal whistleblower protection system<\/a>, weak as it is.  A <a target=\"_blank\" href=\"https:\/\/democracywatch.ca\/house-committee-recommends-key-changes-to-strengthen-federal-government-whistleblower-protection-will-the-liberals-finally-make-the-changes\/\" rel=\"noopener noreferrer\">House Committee unanimously recommended in June 2017<\/a> most of the key changes to make the system effective.
