Commissioner Mario Dion and the 9-page letter it has sent to RCMP Commissioner Brenda Lucki, calling for investigations and rulings on the confirmed actions of Finance Minister Bill Morneau and others acting on his behalf participating in and trying to influence the decision the government claims public servants made on their own to recommend that a sole-source contract of up to $43,5 million be awarded to WE Charity to administer the <a target=\"_blank\" href=\"https:\/\/www.jobbank.gc.ca\/volunteer\/initiative\" rel=\"noopener noreferrer\">Canada Student Service Grant (CSSG) program<\/a>.<\/p>\n\n<p>DWatch\u2019s letter to the Ethics Commissioner also calls on him to rule that, by announcing $3 million in funding to WE Charity in August 2019, Minister Morneau violated the federal ethics law.<\/p>\n\n<p>Two weeks ago, Democracy Watch called for <a target=\"_blank\" href=\"https:\/\/democracywatch.ca\/democracy-watch-calls-for-different-ethics-inquiry-into-we-charity-contract-and-also-for-different-rcmp-investigation\/\" rel=\"noopener noreferrer\">similar investigations<\/a> by the Ethics Commissioner and RCMP of the actions of Prime Minister Trudeau and his PMO staff and officials in participating in the decision to hand WE Charity the contract.<\/p>\n\n<p>As Democracy Watch\u2019s letter details, Minister Morneau\u2019s family has had extensive ties to WE Charity since at least the summer of 2017 which created a conflict of interest for him, including his one daughter working with the organization in the past, his other daughter currently working for the organization, and he and his wife donating a total of $100,000 to the organization since 2018.<\/p>\n\n<p>Therefore, as the evidence revealed last week makes clear, especially in <a target=\"_blank\" href=\"https:\/\/parlvu.parl.gc.ca\/Harmony\/en\/PowerBrowser\/PowerBrowserV2\/20200722\/-1\/33603?Language=English&amp;Stream=Video\" rel=\"noopener noreferrer\">the July 22nd<sup> <\/sup>testimony at the House Finance Committee<\/a> by Minister Morneau and Department of Finance Assistant Deputy Minister Michelle Kovacevic, by participating in and attempting to influence the contracting process with WE Charity from April 5 to June 3, 2020, including through actions by his staff and officials acting on his behalf, and by announcing $3 million in funding for WE Charity in August 2019, Minister Morneau <a target=\"_blank\" href=\"https:\/\/laws-lois.justice.gc.ca\/eng\/acts\/c-36.65\/page-2.html#h-92089\" rel=\"noopener noreferrer\">violated subsection 6(1) and section 9 of the federal <em>Conflict of Interest Act<\/em><\/a> (and <a target=\"_blank\" href=\"https:\/\/laws-lois.justice.gc.ca\/eng\/acts\/c-36.65\/page-3.html#h-92196\" rel=\"noopener noreferrer\">section 21<\/a> by Commissioner to ensure this inquiry is undertaken because the letters from Conservative <a target=\"_blank\" href=\"https:\/\/twitter.com\/MikeBarrettON\/status\/1286349414852898817\" rel=\"noopener noreferrer\">MPs Barrett, Poilievre and Cooper<\/a> (July 23rd) and NDP <a target=\"_blank\" href=\"https:\/\/69490847-1bbc-4d85-bb17-dc869f025e9a.filesusr.com\/ugd\/3c9b44_532d35d724a8430b86587eda21e7d76d.pdf\" rel=\"noopener noreferrer\">MP Charlie Angus<\/a> (also July 23rd) to Ethics Commissioner Dion only request that Mr. Dion investigate whether Minister Morneau violated the <em>Act<\/em> when he and his family accepted more than $41,000 in travel expenses from WE Charity in 2017.<\/p>\n\n<p>The MPs\u2019 requests do not ask the Ethics Commissioner to investigate and rule on whether Minister Morneau or anyone acting on his behalf violated the <em>Act<\/em> by participating in and\/or tried to influence the decision to recommend a sole-source contract be given to WE Charity, nor whether Minister Morneau violated the <em>Act<\/em> by announcing the August 2019 funding for WE Charity.<\/p>\n\n<p><strong>Letter to RCMP re: breach of trust investigation<\/strong><\/p>\n\n<p>DWatch also released the <a target=\"_blank\" href=\"https:\/\/democracywatch.ca\/wp-content\/uploads\/LettToRCMPreMorneauAndWECharityContractJuly272020.pdf\" rel=\"noopener noreferrer\">9-page letter<\/a> it mailed to the RCMP on Monday calling for an investigation into whether Minister Morneau or anyone acting on his behalf, by participating in and attempting to influence the decision to recommend a sole-source contract be awarded to WE Charity, violated the <a target=\"_blank\" href=\"https:\/\/laws-lois.justice.gc.ca\/eng\/acts\/c-46\/page-31.html#docCont\" rel=\"noopener noreferrer\">section 122 breach of trust<\/a> section of the <em>Criminal Code<\/em>.<\/p>\n\n<p>Under the <a target=\"_blank\" href=\"http:\/\/canlii.ca\/t\/1nwwj\" rel=\"noopener noreferrer\">Supreme Court of Canada\u2019s ruling in <em>R. v. Boulanger<\/em><\/a> (para. 58), there is a five-part test for breach of trust.  The WE Charity contract situation involves evidence for all five parts, as Minister Morneau 1. is a public official; 2. who took part in an official decision; 3. that violates the ethics rules for his office; 4. and violates those rules in a significant way, and; 5. Minister Morneau and his family had accepted more than $41,000 in travel expenses from the WE Charity in 2017, and donated more than $100,000, which he did not disclose to officials during the contracting process.  Given Morneau clearly knows the requirements of the <i>Conflict of Interest Act<\/i> as he was <a target=\"_blank\" href=\"http:\/\/prciec-rpccie.parl.gc.ca\/EN\/PublicRegistries\/Pages\/Declaration.aspx?DeclarationID=425d5023-69be-e711-8e4d-000e1e0776f0\" rel=\"noopener noreferrer\">found guilty of not disclosing a private interest in 2017<\/a>, <a target=\"_blank\" href=\"https:\/\/ciec-ccie.parl.gc.ca\/en\/publications\/Documents\/InvestigationReports\/Morneau%20Report.pdf\" rel=\"noopener noreferrer\">was investigated in 2018 for violating subsection 6(1)<\/a> of the <i>Act<\/i>, and <a target=\"_blank\" href=\"http:\/\/prciec-rpccie.parl.gc.ca\/EN\/PublicRegistries\/Pages\/Declaration.aspx?DeclarationID=23d802ea-70c4-e511-aefb-002655368060\" rel=\"noopener noreferrer\">has a conflict screen<\/a> to prevent him from participating in decisions that affect his family&#8217;s company Morneau Shepell Inc., his actions point to a dishonest and corrupt intent in his actions which unethically furthered the financial interests of one of his family\u2019s favourite charities.<\/p>\n\n<p><em>\u201cDemocracy Watch is calling on the Ethics Commissioner to ensure an independent investigation and ruling on Minister Morneau and anyone acting on his behalf participating in and attempting to influence the decision-making process in spring 2020 in favour of recommending that a sole-source contract be awarded to WE Charity worth up to $43.5 million, and also on his announcement of $3 million in funding for WE Charity in August 2019,\u201d<\/em> said Duff Conacher, Co-founder of Democracy Watch. <em>\u201cEthics Commissioner Dion cannot do this investigation as he was handpicked by the Trudeau Cabinet <a target=\"_blank\" href=\"https:\/\/democracywatch.ca\/democracy-watch-in-court-today-challenging-trudeau-cabinets-biased-secretive-appointment-of-new-ethics-commissioner\/\" rel=\"noopener noreferrer\">through a secretive, dishonest process<\/a> that the Federal Court of Appeal ruled was biased, <a target=\"_blank\" href=\"https:\/\/democracywatch.ca\/liberals-proposed-candidate-for-ethics-commissioner-has-record-of-unethical-and-questionable-actions\/\" rel=\"noopener noreferrer\">he has a record of 8 unethical and questionable actions<\/a> when he was Integrity Commissioner and <a target=\"_blank\" href=\"https:\/\/democracywatch.ca\/democracy-watch-calls-on-integrity-commissioner-to-ensure-independent-investigation-into-ethics-commissioners-senior-lawyer-who-is-liberal-cabinet-minister-dominic-leblancs-sister-in\/\" rel=\"noopener noreferrer\">his senior lawyer is a Trudeau Cabinet minister\u2019s sister-in-law<\/a>.
