According to the article: \u201cThe Prime Minister\u2019s Office said Ms. Telford did not recuse herself from discussions about the contract\u2026\u201d<\/p>\n\n<p>Democracy Watch is calling on the Ethics Commissioner to ensure a second inquiry is undertaken because the letters from Conservative <a target=\"_blank\" href=\"https:\/\/twitter.com\/MikeBarrettON\/status\/1279154590412419072\/photo\/3\" rel=\"noopener noreferrer\">MP Michael Barrett<\/a> (June 28th) and NDP <a target=\"_blank\" href=\"https:\/\/69490847-1bbc-4d85-bb17-dc869f025e9a.filesusr.com\/ugd\/3c9b44_165b0457fca645e08018b3e7c9a07fac.pdf\" rel=\"noopener noreferrer\">MP Charlie Angus<\/a> (July 3rd) to Ethics Commissioner Dion did not request that Mr. Dion investigate whether PM Trudeau or anyone acting on his behalf tried to influence the decision to recommend a sole-source contract, a decision the PM claims the public service made on its own.<\/p>\n\n<p>Commissioner Dion\u2019s July 3rd response letters to <a target=\"_blank\" href=\"https:\/\/twitter.com\/MikeBarrettON\/status\/1279154583307202567\/photo\/1\" rel=\"noopener noreferrer\">MP Barrett<\/a> and to <a target=\"_blank\" href=\"https:\/\/twitter.com\/CharlieAngusNDP\/status\/1279163486476664835\/photo\/1\" rel=\"noopener noreferrer\">MP Angus<\/a>, and <a target=\"_blank\" href=\"https:\/\/twitter.com\/EthicsCanada\/status\/1279157898631774208\" rel=\"noopener noreferrer\">his office\u2019s tweet that day<\/a> say that he is <em>only<\/em> investigating whether Prime Minister Trudeau violated subsection 6(1) and sections 21 and 7 of the <em>Act<\/em>.  And his response letters and tweet all strongly suggest that Commissioner Dion is <em>only<\/em> investigating the Prime Minister\u2019s actions of <a target=\"_blank\" href=\"https:\/\/www.cbc.ca\/news\/politics\/student-grant-trudeau-1.5626475\" rel=\"noopener noreferrer\">announcing the WE Charity contract<\/a> on June 25th, and <a target=\"_blank\" href=\"https:\/\/www.cbc.ca\/news\/politics\/we-charity-student-volunteer-program-1.5628610\" rel=\"noopener noreferrer\">defending the contract<\/a> afterwards with <a target=\"_blank\" href=\"https:\/\/www.cbc.ca\/news\/politics\/trudeau-we-charity-volunteer-1.5635501\" rel=\"noopener noreferrer\">the false claim<\/a> that WE is the only organization that could administer the CSSG.<\/p>\n\n<p>As Democracy Watch\u2019s letter summarizes, DWatch\u2019s position is that evidence revealed since July 3rd shows clearly those actions by Prime Minister Trudeau violated those sections.  The PM\u2019s spouse <a target=\"_blank\" href=\"https:\/\/www.we.org\/en-CA\/we-stories\/local-impact\/sophie-gregoire-trudeau-inspires-positive-well\" rel=\"noopener noreferrer\">volunteers as an ambassador<\/a> and champion for WE Charity, including hosting a <a target=\"_blank\" href=\"https:\/\/www.we.org\/en-CA\/get-doing\/activities-and-resources\/wellbeing\/we-well-being-podcast\/\" rel=\"noopener noreferrer\">podcast<\/a> for it, and <a target=\"_blank\" href=\"https:\/\/www.canadalandshow.com\/trudeau-family-paid-by-we-organization\/\" rel=\"noopener noreferrer\">his mother and brother have been paid large sums<\/a> to give speeches for the charity, and the PM has also appeared at several WE events.  Given these ties, the PM had clear conflict of interest concerning any decision that furthered the interests of the charity.<\/p>\n\n<p>As a result, when the PM revealed on July 8th that <a target=\"_blank\" href=\"https:\/\/globalnews.ca\/news\/7153106\/trudeau-we-charity-recuse\/\" rel=\"noopener noreferrer\">he didn\u2019t recuse himself from the Cabinet decision to approve the WE Charity contract<\/a>, he essentially admitted that he had violated <a target=\"_blank\" href=\"https:\/\/laws-lois.justice.gc.ca\/eng\/acts\/c-36.65\/page-2.html#h-92089\" rel=\"noopener noreferrer\">subsection 6(1)<\/a> and <a target=\"_blank\" href=\"https:\/\/laws-lois.justice.gc.ca\/eng\/acts\/c-36.65\/page-3.html#h-92196\" rel=\"noopener noreferrer\">section 21<\/a> of the <em>Act<\/em>, which together require recusal when in even an appearance of a conflict of interest.<\/p>\n\n<p>And by participating in approving a sole-source contract for WE Charity, while making <a target=\"_blank\" href=\"https:\/\/www.cbc.ca\/news\/politics\/trudeau-we-charity-volunteer-1.5635501\" rel=\"noopener noreferrer\">the false claim that WE is the only organization that could administer the CSSG<\/a> program, Prime Minister Trudeau also provided preferential treatment to WE based on who represents the charity, which violates <a target=\"_blank\" href=\"https:\/\/laws-lois.justice.gc.ca\/eng\/acts\/c-36.65\/page-2.html#h-92089\" rel=\"noopener noreferrer\">section 7<\/a> of the <em>Act<\/em>.<\/p>\n\n<p><strong>Letter to RCMP re: breach of trust investigation<\/strong><\/p>\n\n<p>DWatch also released the 10-page <a target=\"_blank\" href=\"https:\/\/democracywatch.ca\/wp-content\/uploads\/LettToRCMPrePMandWECharityContractJuly102020.pdf\" rel=\"noopener noreferrer\">letter it mailed to the RCMP<\/a> last Friday calling for an investigation into whether the PM or anyone acting on his behalf attempted to influence anyone\u2019s decision to recommend a sole-source contract be awarded to WE Charity.<\/p>\n\n<p>This is different than the <a target=\"_blank\" href=\"https:\/\/globalnews.ca\/news\/7161679\/tories-call-for-criminal-probe-we-contracts-trudeau-family-fees\/\" rel=\"noopener noreferrer\">request the Conservative Party<\/a> has reportedly sent to the RCMP that asks for an investigation into whether WE Charity essentially bribed the Prime Minister\u2019s family in order to obtain the contract.<\/p>\n\n<p>In DWatch\u2019s opinion, if the PM or anyone acting on his behalf attempted to influence that decision, it is worthy of an investigation to determine if they violated the <a target=\"_blank\" href=\"https:\/\/laws-lois.justice.gc.ca\/eng\/acts\/c-46\/page-31.html#docCont\" rel=\"noopener noreferrer\">section 122 breach of trust<\/a> section of the <em>Criminal Code<\/em>.  Under the <a target=\"_blank\" href=\"http:\/\/canlii.ca\/t\/1nwwj\" rel=\"noopener noreferrer\">Supreme Court of Canada\u2019s ruling in <em>R. v. Boulanger<\/em><\/a> (para. 58), there is a five-part test for breach of trust.  The WE Charity contract situation involves evidence for all five parts, as the Prime Minister 1. is a public official; 2. who took part in an official decision; 3. that violates the ethics standards for his office; 4. and violates those rules in a significant way, and; 5. the Prime Minister made dishonest statements to excuse his participation in the decision, all to unethically further the financial interests of one of his wife\u2019s favourite charities.<\/p>\n\n<p>DWatch will be sending a follow-up letter to the RCMP with the new information <a target=\"_blank\" href=\"https:\/\/www.theglobeandmail.com\/politics\/article-oregan-telford-helped-raise-400000-for-we-charity\/\" rel=\"noopener noreferrer\">revealed on Sunday by the <em>Globe<\/em><\/a> about Katie Telford\u2019s involvement in the contracting process.<\/p>\n\n<p><strong>Letter re: Finance Minister Bill Morneau taking part in approval of contract<\/strong><\/p>\n\n<p>Democracy Watch also released the <a target=\"_blank\" href=\"https:\/\/democracywatch.ca\/wp-content\/uploads\/LettToEthicsCommReMorneauAndWECharityContractJuly132020.pdf\" rel=\"noopener noreferrer\">6-page letter<\/a> it has sent to the Ethics Commissioner concerning Finance Minister Bill Morneau participating in the Cabinet decision to approve the WE Charity contract. The WE Charity contract situation involves evidence for all five parts, as the Prime Minister 1. is a public official; 2. who took part in an official decision; 3. that violates the ethics standards for his office; 4. and violates those rules in a significant way, and; 5. the Prime Minister made dishonest statements to excuse his participation in the decision, all to unethically further the financial interests of one of his wife\u2019s favourite charities.<\/p>\n\n<p>DWatch will be sending a follow-up letter to the RCMP with the new information <a target=\"_blank\" href=\"https:\/\/www.theglobeandmail.com\/politics\/article-oregan-telford-helped-raise-400000-for-we-charity\/\" rel=\"noopener noreferrer\">revealed on Sunday by the <em>Globe<\/em><\/a> about Katie Telford\u2019s involvement in the contracting process.<\/p>\n\n<p><strong>Letter re: Finance Minister Bill Morneau taking part in approval of contract<\/strong><\/p>\n\n<p>Democracy Watch also released the <a target=\"_blank\" href=\"https:\/\/democracywatch.ca\/wp-content\/uploads\/LettToEthicsCommReMorneauAndWECharityContractJuly132020.pdf\" rel=\"noopener noreferrer\">6-page letter<\/a> it has sent to the Ethics Commissioner concerning Finance Minister Bill Morneau participating in the Cabinet decision to approve the WE Charity contract.  Given Minister Morneau\u2019s one daughter has worked with the organization, and his other daughter works for the organization, DWatch\u2019s position is that he violated subsection 6(1) and section 21 of the <em>CofI Act<\/em> by participating in the contract decision.<\/p>\n\n<p><em>\u201cDemocracy Watch is calling on the Ethics Commissioner to ensure an independent investigation into the big, key question the Commissioner is not yet investigating \u2013 did Prime Minister Trudeau or anyone acting on his behalf attempt to influence the decision in favour of recommending that a sole-source contract be awarded to WE Charity?\u201d<\/em> said Duff Conacher, Co-founder of Democracy Watch. <em>\u201cEthics Commissioner Dion cannot do this investigation as he was handpicked by the Trudeau Cabinet <a target=\"_blank\" href=\"https:\/\/democracywatch.ca\/democracy-watch-in-court-today-challenging-trudeau-cabinets-biased-secretive-appointment-of-new-ethics-commissioner\/\" rel=\"noopener noreferrer\">through a secretive, dishonest process<\/a> that is being challenged in court, <a target=\"_blank\" href=\"https:\/\/democracywatch.ca\/liberals-proposed-candidate-for-ethics-commissioner-has-record-of-unethical-and-questionable-actions\/\" rel=\"noopener noreferrer\">he has a record of 8 unethical and questionable actions<\/a> when he was Integrity Commissioner and <a target=\"_blank\" href=\"https:\/\/democracywatch.ca\/democracy-watch-calls-on-integrity-commissioner-to-ensure-independent-investigation-into-ethics-commissioners-senior-lawyer-who-is-liberal-cabinet-minister-dominic-leblancs-sister-in\/\" rel=\"noopener noreferrer\">his senior lawyer is a Trudeau Cabinet minister\u2019s sister-in-law<\/a>.
