{"id":11510,"date":"2020-01-30T06:25:29","date_gmt":"2020-01-30T11:25:29","guid":{"rendered":"https:\/\/democracywatch.ca\/?p=11510"},"modified":"2025-05-25T07:18:31","modified_gmt":"2025-05-25T11:18:31","slug":"almost-two-years-later-where-is-lobbying-commissioners-ruling-on-facebooks-lobbying-and-favours-for-liberal-cabinet","status":"publish","type":"post","link":"https:\/\/democracywatch.ca\/fr\/almost-two-years-later-where-is-lobbying-commissioners-ruling-on-facebooks-lobbying-and-favours-for-liberal-cabinet\/","title":{"rendered":"Almost two years later, where is Lobbying Commissioner\u2019s ruling on Facebook\u2019s lobbying and favours for Liberal Cabinet?Almost two years later, where is Lobbying Commissioner\u2019s ruling on Facebook\u2019s lobbying and favours for Liberal Cabinet?"},"content":{"rendered":"<h3 align=\"center\"><span style=\"color: black;\">Given federal government is reviewing social media rules, ruling must be made public on whether Facebook violated lobbying law and ethics code<\/span><\/h3>\n<h3 align=\"center\"><span style=\"color: black;\">Lobbying Commissioner has ruled on a dozen other complaints filed since Democracy Watch filed its April 2018 complaint<\/span><\/h3>\n\n<p><b>FOR IMMEDIATE RELEASE:<\/b><br>Thursday, January 30, 2020<\/p>\n\n<p>OTTAWA \u2013 Today, Democracy Watch sent another <a target=\"_blank\" href=\"https:\/\/democracywatch.ca\/wp-content\/uploads\/LettToFedLobbyCommReFacebookJan302020.pdf\" rel=\"noopener noreferrer\">letter<\/a> to federal Lobbying Commissioner Nancy B\u00e9langer, following up on <a target=\"_blank\" href=\"https:\/\/democracywatch.ca\/more-than-a-year-later-where-is-lobbying-commissioners-ruling-on-facebooks-lobbying-and-favours-for-liberal-cabinet\/\" rel=\"noopener noreferrer\">its August 1, 2019 letter<\/a>, calling on her to ensure an independent ruling on the <a target=\"_blank\" href=\"https:\/\/democracywatch.ca\/democracy-watch-files-complaint-about-facebook-lobbying-and-favours-for-politicians-with-federal-lobbying-commissioner\/\" rel=\"noopener noreferrer\">complaint letter it filed in late April 2018<\/a> about unregistered lobbying and doing favours for Cabinet and federal politicians by Facebook employees, and employees of its subsidiary Instagram.<\/p>\n\n<p>As of the end of March 2019, the Lobbying Commissioner had investigated and ruled on a dozen other complaints and\/or situations filed since April 2018.<\/p>\n\n<p><em>\u201cAlmost two years ago, Democracy Watch filed a complaint calling for an investigation of Facebook\u2019s unregistered lobbying and favours for Liberal Cabinet ministers and MPs, and the Lobbying Commissioner has negligently failed to issue a ruling on the complaint,\u201d<\/em> said Duff Conacher, Co-founder of Democracy Watch. <em>\u201cThe Lobbying Commissioner has issued rulings on a dozen complaints filed since spring 2018, and so the Commissioner\u2019s delay in ruling on Democracy Watch\u2019s April 2018 complaint is completely unjustifiable, and likely linked to the fact that the Commissioner was handpicked by Prime Minister Trudeau.\u201d<\/em><\/p>\n\n<p>The federal <em>Lobbying Act<\/em> requires businesses to register if its employees <span><a target=\"_blank\" href=\"https:\/\/lobbycanada.gc.ca\/eic\/site\/012.nsf\/eng\/00115.html\" rel=\"noopener noreferrer\">spent more than 20% of their collective time lobbying<\/a> <\/span>during any 6-month period, including arranging meetings, and <span>some communications are also required to be disclosed in <a target=\"_blank\" href=\"http:\/\/laws.justice.gc.ca\/eng\/regulations\/SOR-2008-116\/index.html\" rel=\"noopener noreferrer\">monthly reports<\/a><\/span>.  The Professionalism principle in the <em><a target=\"_blank\" href=\"https:\/\/lobbycanada.gc.ca\/eic\/site\/012.nsf\/eng\/h_00014.html\" rel=\"noopener noreferrer\">Lobbyists\u2019 Code of Conduct<\/a><\/em> requires that lobbyists follow the spirit of the registration requirements of the <em>Act<\/em>.<span>  As well, <\/span>the <em>Lobbyists\u2019 Code <\/em>prohibits anyone from lobbying a Cabinet minister or their officials for four years after doing favours for them (<a target=\"_blank\" href=\"https:\/\/lobbycanada.gc.ca\/eic\/site\/012.nsf\/eng\/01195.html\" rel=\"noopener noreferrer\">former Rule 8<\/a> and, since December 2015, <a target=\"_blank\" href=\"https:\/\/lobbycanada.gc.ca\/eic\/site\/012.nsf\/eng\/h_00015.html\" rel=\"noopener noreferrer\">Rules 6-9<\/a>).<\/p>\n\n<p>Democracy Watch\u2019s April 2018 complaint asked whether Facebook\u2019s employees had ever crossed the 20% line from 2010 to 2018 and violated the <em>Act<\/em> by failing to register, and whether any of Facebook\u2019s employees violated the <em>Code<\/em> by doing favours for Cabinet ministers or MPs and then lobbying them afterwards.<\/p>\n\n<p>As <a target=\"_blank\" href=\"http:\/\/www.macleans.ca\/politics\/ottawa\/what-facebook-is-not-doing-in-ottawa\/\" rel=\"noopener noreferrer\">Maclean\u2019s magazine first reported<\/a>, Facebook was not registered as a company in the Registry of Lobbyists to lobby the federal government from 2010 on, until it <a target=\"_blank\" href=\"https:\/\/www.theglobeandmail.com\/politics\/article-facebook-agrees-to-join-federal-lobbyist-registry\/\" rel=\"noopener noreferrer\">announced in spring 2018 it would register<\/a> (while still maintaining that it is not required to register).  Facebook also has several consultant lobbyists on contract but they have reported only one communication with federal government politicians and officials since 2014.<\/p>\n\n<p>In contrast, other social media companies such as Google have had several employees and consultant lobbyists registered for years, and many monthly communications reports.<\/p>\n\n<p>As well, Facebook has provided <a target=\"_blank\" href=\"https:\/\/www.ctvnews.ca\/politics\/facebook-canada-debuts-new-email-crisis-line-to-thwart-election-cyberthreats-1.3640410\" rel=\"noopener noreferrer\">cyber-threat training and services for free to federal politicians<\/a>, and Facebook Canada\u2019s head of public policy Kevin Chan <a target=\"_blank\" href=\"https:\/\/www.theglobeandmail.com\/politics\/article-facebook-executive-with-liberal-ties-denies-lobbying-finance-minister\/\" rel=\"noopener noreferrer\">provided advice for free to Finance Minister Morneau<\/a> about how to do a Facebook Live event for his budget speech.<\/p>\n\n<p>Democracy Watch also recently requested that the Lobbying Commissioner rule on <a target=\"_blank\" href=\"https:\/\/democracywatch.ca\/two-and-a-half-years-later-where-is-lobbying-commissioners-ruling-on-council-of-canadian-innovators-lobbying-of-liberal-cabinet\/\" rel=\"noopener noreferrer\">another two-year-old complaint<\/a> involving Liberal Cabinet ministers.<\/p>\n\n<p>Democracy Watch requested in its April 2018 letter that Lobbying Commissioner B\u00e9langer recuse herself from ruling on the situation because she was handpicked by Trudeau, and has also made statements that show a bias in favour of lobbyists.<\/p>\n\n<p>Democracy Watch <a target=\"_blank\" href=\"https:\/\/democracywatch.ca\/democracy-watch-in-court-today-challenging-trudeau-cabinets-biased-secretive-appointments-of-ethics-commissioner-and-lobbying-commissioner\/\" rel=\"noopener noreferrer\">challenged<\/a> Commissioner B\u00e9langer\u2019s appointment in court.  The Federal Court of Appeal <a target=\"_blank\" href=\"https:\/\/decisions.fca-caf.gc.ca\/fca-caf\/decisions\/en\/item\/460437\/index.do\" rel=\"noopener noreferrer\">ruled on Tuesday<\/a> that the Trudeau Cabinet was biased when it appointed her but that the bias was \u201cinevitable\u201d and is allowed under a <a target=\"_blank\" href=\"http:\/\/canlii.ca\/t\/520r\" rel=\"noopener noreferrer\">2001 Supreme Court of Canada ruling<\/a>.
