The Commissioner confirmed that the complaint was being investigated in a <a target=\"_blank\" href=\"https:\/\/democracywatch.ca\/wp-content\/uploads\/LettFromLobbyCommApptReCCIJul202017-1.pdf\" rel=\"noopener noreferrer\">July 20, 2017 letter<\/a>.<\/p>\n\n<p>As of the end of March 2019, the Lobbying Commissioner had investigated and ruled on 14 other complaints and\/or situations filed since September 2017 (two months after Democracy Watch filed its complaint about CCI\u2019s lobbying).<\/p>\n\n<p><em>\u201cDemocracy Watch\u2019s July 2017 complaint provided detailed evidence to the Lobbying Commissioner, and the Commissioner is being completely negligent by continuing to fail to issue a ruling two-and-half years later,\u201d<\/em> said Duff Conacher, Co-founder of Democracy Watch. <em>\u201cThe Lobbying Commissioner has issued rulings on more than a dozen complaints filed since September 2017, and so the Commissioner\u2019s delay in ruling on Democracy Watch\u2019s July 2017 complaint is completely unjustifiable, and likely linked to the fact that the Commissioner was handpicked by Prime Minister Trudeau.\u201d<\/em><\/p>\n\n<p>Democracy Watch has requested that the Lobbying Commissioner recuse herself from ruling on the situation because she was handpicked by Trudeau.  Democracy Watch is <a target=\"_blank\" href=\"https:\/\/democracywatch.ca\/democracy-watch-in-court-today-challenging-pm-trudeaus-biased-secretive-appointment-of-new-lobbying-commissioner\/\" rel=\"noopener noreferrer\">challenging<\/a> Lobbying Commissioner B\u00e9langer\u2019s appointment in the Federal Court of Appeal, with the hearing scheduled for January 28th. Democracy Watch is also challenging two rulings issued by Commissioner Belanger in Federal Court (see details <a target=\"_blank\" href=\"https:\/\/democracywatch.ca\/democracy-watchs-lawsuit-challenges-lobbying-commissioners-ruling-that-investigation-should-not-continue-into-former-apotex-chairman-barry-shermans-fundraising-for-trudeau-l\" rel=\"noopener noreferrer\">here<\/a> and <a target=\"_blank\" href=\"https:\/\/democracywatch.ca\/democracy-watchs-lawsuit-challenges-lobbying-commissioners-ruling-letting-clearwater-seafoods-board-member-off-the-hook-for-fundraising-event-trudeau-attended\/\" rel=\"noopener noreferrer\">here<\/a>) and <a target=\"_blank\" href=\"https:\/\/democracywatch.ca\/trudeau-liberals-appeal-of-federal-court-ruling-ordering-lobbying-commissioner-to-investigate-aga-khans-bahamas-trip-gift-to-pm-trudeau-in-court-today\/\" rel=\"noopener noreferrer\">one ruling<\/a> issued by former Commissioner Shepherd.<\/p>\n\n<p>The federal <em>Lobbyists\u2019 Code of Conduct<\/em> prohibits anyone from lobbying a Cabinet minister or their officials for four years after helping them get elected (<a target=\"_blank\" href=\"https:\/\/lobbycanada.gc.ca\/eic\/site\/012.nsf\/eng\/01195.html\" rel=\"noopener noreferrer\">former Rule 8<\/a> and, since December 2015, <a target=\"_blank\" href=\"https:\/\/lobbycanada.gc.ca\/eic\/site\/012.nsf\/eng\/h_00015.html\" rel=\"noopener noreferrer\">Rules 6-9<\/a> (see especially <a target=\"_blank\" href=\"https:\/\/lobbycanada.gc.ca\/eic\/site\/012.nsf\/eng\/01479.html\" rel=\"noopener noreferrer\">Rule 9<\/a>)).  The question posed in Democracy Watch\u2019s July 2017 complaint was whether Minister Freeland\u2019s former campaign managers violated the <em>Code<\/em> given that they <a target=\"_blank\" href=\"https:\/\/www.canadianinnovators.org\/contact\" rel=\"noopener noreferrer\">headed up CCI<\/a>, and CCI had lobbied the foreign affairs and trade departments.<\/p>\n\n<p>Since March 2016, the CCI\u2019s Executive Director has been Benjamin Bergen, who according to <a target=\"_blank\" href=\"https:\/\/www.theglobeandmail.com\/news\/politics\/lobby-group-asked-to-stop-offering-access-to-ottawa-for-cash\/article35660454\/\" rel=\"noopener noreferrer\">this <em>Globe and Mail<\/em> article<\/a>, and this <a target=\"_blank\" href=\"https:\/\/www.cantechletter.com\/2016\/03\/ben-bergen-appointed-executive-director-of-council-of-canadian-innovators\/\" rel=\"noopener noreferrer\">CanTechLetter.com article<\/a>, played a senior management role in the 2015 federal election campaign of former International Trade Minister and, from January 2017 to November 2019, <a target=\"_blank\" href=\"http:\/\/www.pm.gc.ca\/eng\/minister\/honourable-chrystia-freeland\" rel=\"noopener noreferrer\">Minister of Foreign Affairs Chrystia Freeland<\/a> (Ms. Freeland is now <a target=\"_blank\" href=\"https:\/\/pm.gc.ca\/en\/cabinet\/honourable-chrystia-freeland\" rel=\"noopener noreferrer\">Deputy Prime Minister and Minister of Intergovernmental Affairs<\/a>).  And Dana O\u2019Born was CCI\u2019s Director of Policy and is now its Director of Strategic Initiatives.
